1. Beta and Evaluation Status

CloudCutter_E57 V1.1 Trial is beta software provided for evaluation, testing, workflow assessment, and product feedback.

It is not represented as a final, fully validated production release.

The software may contain:

- bugs;
- incomplete features;
- unexpected behavior;
- performance limitations;
- format-specific limitations;
- metadata-preservation limitations;
- interruptions caused by unusual, malformed, or damaged source files.


2. No Warranty

The software is provided "as is" and "as available", without warranties of any kind, except where warranties cannot legally be excluded.

To the maximum extent permitted by applicable law, no express or implied warranty is provided regarding:

- merchantability;
- fitness for a particular purpose;
- accuracy;
- completeness;
- uninterrupted operation;
- compatibility with every point-cloud file or third-party application;
- preservation of all source metadata;
- availability of licensing or online services;
- suitability for production, safety-critical, contractual, or regulated use.


3. User Responsibility

Use of CloudCutter is at the user's own risk.

The user is responsible for:

- keeping original source files unchanged;
- using backup copies;
- validating all selections;
- validating every exported file;
- confirming geometry, bounds, scale, point count, RGB, and other required attributes;
- checking compatibility with downstream software;
- confirming that the output is suitable for its intended engineering or commercial purpose;
- complying with internal company rules and applicable laws.

Exported files should be checked in an independent point-cloud application before production use.


4. Data and Metadata Limitations

Point-cloud formats differ in structure and supported attributes.

Conversion or cutting may affect or omit:

- RGB;
- intensity;
- scanner grouping;
- scan positions;
- row/column structure;
- classifications;
- Image2D blocks;
- scanner photographs;
- scanner-specific metadata;
- other source-specific information.

Geometry is the primary transferable content.

Preservation of other attributes depends on:

- source format;
- source structure;
- destination format;
- selected export mode;
- active reader/writer path;
- third-party compatibility.

Some non-Cartesian or structured E57 files may require XYZ-only export in certain workflows.


5. Large-File and Performance Limitations

Processing time and memory use depend on:

- file size;
- point count;
- file format;
- coarse tile size;
- number of occupied tiles;
- available RAM;
- storage speed;
- network or removable-drive availability;
- source-file complexity.

Very large files may require long preview or export times.

The application may not always provide accurate remaining-time estimates.

The user should test the workflow on a smaller region before processing critical datasets.


6. Trial Licensing and Online Services

CloudCutter Trial requires online licensing services.

An Internet connection is required:

- for initial email verification and activation;
- for startup validation;
- before every export.

The Trial is shared by the registered organization and supports up to 10 fixed devices.

The Trial period begins with the first organization activation and does not restart for additional devices.

Access may be denied when:

- the Trial has expired;
- the device limit has been reached;
- the organization, Trial, device, or session has been blocked or revoked;
- the email domain is not eligible;
- the licensing service rejects the request;
- required online validation cannot be completed.

A short transport-failure tolerance, where available, does not authorize export and does not override a server rejection.

No guarantee is made that online licensing, email delivery, or related services will be continuously available.


7. Organization and Email Resolution

CloudCutter may associate users with an organization based on the verified email domain.

If a domain is already registered, the application may display and use the existing canonical organization name instead of the manually entered name.

The user must review the displayed organization before confirming activation.

Selecting Cancel stops activation.

University and student-university email domains may be accepted and statistically monitored for abuse prevention.

Public or disposable email domains may be rejected.


8. Local Trial Session

After activation, an encrypted device session may be stored in the current Windows user profile using Windows DPAPI.

Typical location:

%LOCALAPPDATA%\VoxelStudio\CloudCutter\trial_license_v2.dat

The user must not:

- copy the cache to another person or device;
- attempt to modify or forge the cache;
- bypass online validation;
- bypass export authorization;
- reuse consumed or expired authorizations;
- interfere with licensing or security controls.

Replacing the EXE does not reset the server-side Trial or device status.


9. Security and Antivirus

Windows SmartScreen or antivirus products may warn about a new or low-distribution executable.

The user should:

- obtain the package only from the official source;
- verify the published SHA-256 checksum;
- follow company security policy;
- avoid disabling antivirus protection globally.

No guarantee is made that every antivirus or endpoint-security product will classify the application identically.


10. Limitation of Liability

To the maximum extent permitted by applicable law, the author, distributor, and related service providers shall not be liable for direct or indirect loss arising from use of, inability to use, or reliance on the software, including but not limited to:

- loss or corruption of data;
- loss of metadata;
- incorrect export;
- project delay;
- business interruption;
- loss of profit;
- loss of opportunity;
- third-party claims;
- incompatibility with downstream software;
- unauthorized or unintended use;
- consequences of failure to verify exported data.

Nothing in this disclaimer excludes liability that cannot legally be excluded under applicable law.


11. Third-Party Components

CloudCutter includes third-party open-source components.

Those components remain subject to their respective licenses and notices.

Applicable third-party information is provided in:

licenses\THIRD_PARTY_NOTICES.txt

and the other files in the licenses folder.

No ownership is claimed over third-party components beyond the rights granted by their licenses.


12. Intellectual Property

CloudCutter_E57 and its original source code, workflows, interface elements, documentation, and application-specific materials are protected by applicable copyright and intellectual-property laws.

Unauthorized copying, redistribution, reverse engineering, circumvention of licensing controls, or creation of derivative commercial packages may be prohibited except where expressly permitted by applicable law.

All trademarks and product names are the property of their respective owners.


13. Acceptance

By installing, activating, or using CloudCutter_E57 V1.1 Trial, the user acknowledges the beta status, online licensing requirements, technical limitations, and responsibility to validate all exported data.

Stop using the software if these conditions are not acceptable.
